2004–2009: Conflict of interest involving Oppenheim-Esch funds owning stores leased to Arcandor

No legal proceedings

Middelhoff and his wife owned interests in Oppenheim-Esch funds holding several department stores leased to Karstadt/Arcandor. As the tenant group's CEO, Middelhoff therefore had conflicting interests: as an investor he benefited from rents, while as CEO he was required to protect Arcandor's interests.

2009: Arcandor bankruptcy months after his departure — disputed management responsibility, but not subject of criminal conviction

No legal proceedings

Middelhoff left Arcandor in February 2009; the group, which owned Karstadt and Quelle among other businesses, filed for insolvency in June after requests for guarantees and public funding failed. His tenure became emblematic of the group's decline, and his strategic and financial decisions were strongly criticised.

No legal proceedings

As Bertelsmann's CEO, Middelhoff pursued an aggressive Internet strategy, supported Napster and committed approximately 90 million dollars to try to transform the service into a lawful paid platform. In 2002, he was removed following a strategic dispute with the board and family shareholders, who favoured a more conservative approach.
