Operation Luxor: major raid targeting 'political Islam', unlawful searches and numerous case closures

Civil / administrative proceedings

Nearly a thousand police officers participated in Operation Luxor against dozens of individuals or organisations suspected of links to the Muslim Brotherhood, Hamas, or financial and terrorist offences. Several searches were subsequently ruled unlawful for lack of sufficiently concrete suspicions, key experts were disqualified over apparent bias, and numerous cases were closed.

Nehammer's social media accounts: public resources used for ÖVP-owned accounts, party fined €50,637

Civil / administrative proceedings — against a third party

Protagonist not prosecuted — these proceedings are not counted in their formal charges or convictions.

Chancellery staff resources were used to manage Facebook, Instagram, TikTok and X accounts used by Nehammer although they legally belonged to the ÖVP. The Court of Audit and subsequently the UPTS determined that the unreimbursed annual public cost was 50,637 euros and classified this benefit as a prohibited donation from the federal government to the party.

Other irregularities in the ÖVP's 2022 financial report under his leadership

Civil / administrative proceedings

The review of the ÖVP's 2022 financial report raised questions about the inclusion of income and expenditure from the Seniorenbund and rural youth organisations, as well as a 3,000-euro donation declared late. The UPTS notably imposed a 6,000-euro fine on the Upper Austrian ÖAAB for late reporting.

2024 electoral defeat, rejection of a Kickl-led coalition and resignation after centrist negotiations fail

No legal proceedings

The FPÖ came first in the September 2024 parliamentary elections, while Nehammer's ÖVP finished second with approximately 26.3%. Nehammer maintained his refusal to join a government led by Herbert Kickl. The Federal President asked him to seek an alternative majority, a decision denounced by the FPÖ as circumventing the election winner. Following the failure of ÖVP-SPÖ-NEOS and then ÖVP-SPÖ talks, Nehammer announced his resignation in January 2025.

BVT affair: initial support for a search later ruled unlawful, followed by criticism from former intelligence chief

No legal proceedings

During the 2018 BVT crisis, Nehammer, then ÖVP Secretary-General, stated in a communication that the operation targeting the intelligence service had been 'coordinated' with the New ÖVP. The search conducted under the FPÖ-led Interior Ministry was subsequently ruled unlawful, and many of the initial suspicions against the BVT proved unfounded. In 2023, former director Peter Gridling criticised Nehammer and the ÖVP for not having provided greater support to the service.

Civil / administrative proceedings

In 2018, as ÖVP Secretary-General, Nehammer claimed that the new, streamlined social insurance structure would save a total of one billion euros by 2023 for the benefit of insured persons. profil subsequently classified this claim as false. In 2022, the Court of Audit concluded that the 'Patientenmilliarde' announced by the government could not be substantiated and that the ministry had been unable to explain how the savings were to be achieved.
