2025–2026: Active federal appeal; DOJ accepts reversal of some §924(j) death sentences after Barrett but opposes new sentencing phase on remaining capital counts

Conviction (not final)

In proceedings before the Third Circuit, the Department of Justice stated in 2026 that death sentences on certain counts under 18 U.S.C. §924(j) should be vacated following Barrett v. United States. It nevertheless argues that a new sentencing phase is unnecessary for the other capital counts that remain valid.
