2025–2026: appointment to ACIP vaccine committee following removal of panel, controversial decisions, court intervention and Malone's resignation

Civil / administrative proceedings

Robert F. Kennedy Jr. appointed Malone among eight new members of the Advisory Committee on Immunization Practices after removing the previous seventeen members. The appointment of an activist critical of mRNA vaccines provoked considerable controversy. In March 2026, a federal judge blocked the panel's work and certain decisions, questioning the appointment process and vaccine expertise of several members. Malone, who had become committee vice-chair, left ACIP a few days later.

2022–2023: defamation claim against Washington Post dismissed; court finds non-actionable opinions and insufficient actual malice allegations

Civil / administrative proceedings

Malone sued the Washington Post over a profile describing his vaccine positions and misinformation allegations. The federal court in Virginia dismissed the claim, finding several passages to be opinions or characterisations not actionable in defamation and concluding that Malone had not sufficiently alleged 'actual malice' regarding the relevant statements.

2021–2022: repeated description as 'inventor of mRNA vaccines', considered exaggerated by historians and researchers in the field

No legal proceedings

Malone has frequently described himself, or been described, as the 'inventor' of messenger RNA vaccine technology. He did carry out important experiments involving RNA transfer into cells in the late 1980s, but the development of mRNA vaccines resulted from decades of collective work involving numerous laboratories and researchers.

2021–2022: permanent Twitter suspension for breaches of Covid policy, followed by reinstatement after platform ownership change

Civil / administrative proceedings

Twitter permanently suspended Malone's account in late December 2021 for repeated violations of its Covid-19 misinformation policy. Following Elon Musk's acquisition of Twitter and the abandonment of some of those rules, his account was reinstated in December 2022.

2021–2022: 'mass formation psychosis' theory offered to explain compliance with Covid measures and comparison with Nazi Germany

No legal proceedings

On Joe Rogan's podcast, Malone suggested that much of the population had fallen victim to a 'mass formation psychosis', allowing authorities to control behaviour surrounding the pandemic, and compared this phenomenon with Nazi Germany in the 1920s–1930s. Psychology specialists stressed that the expression did not correspond to an established diagnosis or scientific concept capable of explaining the pandemic.

2022: speech at anti-vaccine-mandate rally claiming vaccines cause irreversible damage to children's brains, hearts, immunity and fertility

No legal proceedings

At a Washington rally against vaccination mandates, Malone stated that vaccine products could cause irreversible damage to children's brains, nervous systems, hearts, immune systems and reproductive capacity, while claiming that vaccines 'did not work'. Safety and efficacy data did not support these sweeping assertions.

2022: claim that routine influenza vaccination mainly serves to maintain industrial capacity for future pandemics

No legal proceedings

Malone suggested that annual influenza vaccination campaigns were largely intended to keep manufacturing lines ready for a future pandemic rather than prevent influenza itself. The documented objectives of vaccination campaigns are primarily to reduce infections, complications, hospitalisations and deaths.

2021: erroneous claim about full Pfizer/Comirnaty approval and supposed loss of legal protection for manufacturer, subsequently corrected

No legal proceedings

Following the FDA's full approval of the Pfizer-BioNTech vaccine marketed as Comirnaty, Malone claimed that the product actually administered remained authorised only for emergency use and that the approved version would cause the manufacturer to lose certain legal protections. Legal and regulatory analysis showed that this presentation was misleading.
