2026: Appeal hearing ends, prosecution seeks six years and defence acquittal — verdict pending

Formally charged

The appeal hearing took place in August 2026. Prosecutors sought six years' imprisonment for Vincenz and Stocker; the defence teams requested acquittal and raised, among other points, limitation periods affecting certain charges. Vincenz reiterated that he never intended to harm Raiffeisen or Aduno. At the close of proceedings, the presiding judge said judgment would be delivered several weeks later.

2000s–2015: Approximately CHF 200,000 in strip-club expenses charged as business costs

Conviction

At first instance, the trial established that Vincenz had obtained reimbursement from Raiffeisen for numerous expenses at cabarets and strip clubs, approaching 200,000 francs. He maintained that these visits largely involved maintaining business relationships; the court instead found that this interpretation of business expenses went too far.

Conviction (not final)

The first-instance court also found wholly private or insufficiently business-related expenses: family or leisure trips, a 700-franc dinner with a woman met on Tinder described as a job interview, and the repair of a damaged hotel room. The court ordered, among other things, repayment of approximately 300,000 francs to Raiffeisen for improper expenses.

Conviction (not final)

According to the 2022 first-instance judgment, Vincenz and Beat Stocker held an undisclosed stake in Commtrain before the company was acquired by Aduno, of which Vincenz chaired the board and Stocker was CEO. 2024–2025: Judgment annulled for procedural defects, then Federal Supreme Court orders substantive appeal review

No legal proceedings

In 2024, Zurich Higher Court annulled the first-instance judgment, citing, notably, an excessively long indictment and a translation issue affecting a co-defendant. The Federal Supreme Court subsequently overturned that decision, found the indictment legally valid and remitted the case for a substantive appeal hearing.
